TERMS AND CONDITIONS

Rules for using the website, making inquiries and placing individually confirmed SHARENA orders.

1. General provisions

These Terms and Conditions govern the use of https://sharena-art.com (the ‘Website’), as well as relations arising from inquiries and distance contracts for artworks and products presented under the SHARENA brand.

The provider and trader is “SHARENIYKI” EOOD, UIC 208518121, 26 Otets Paisiy St., floor 5, apt. 82, Varna, Bulgaria, email sharena.art@gmail.com, telephone 0893 596 086. The company is not registered for VAT.

A ‘Consumer’ is a natural person who acquires goods for purposes outside their trade or profession. A ‘Visitor’ is a person browsing the Website, and a ‘Client’ is a person who makes an inquiry or enters into a contract with the Trader.

By using the Website, the visitor agrees to comply with these terms. Before entering into a contract, the client is given the opportunity to read and accept them.

2. Nature of the artworks

SHARENA presents original, hand-painted artworks and accessories. Traces of the creative process and minimal differences in colour, line, texture and detail are not defects when they are part of the author’s character and correspond to the description.

On-screen colours may vary slightly depending on the device. This does not release the Trader from the obligation to deliver goods that conform to the contract.

A ‘Sold’ status means that the specific artwork is not available. An ‘Available’ status is expressly confirmed by the Trader because the one-of-a-kind piece may be requested through more than one channel.

3. Prices

Sale prices are in euros and are final. The Trader is not registered for VAT and does not charge VAT. A lev equivalent, if displayed, is for information only.

Delivery is not included unless expressly stated otherwise. Its price is communicated before the contract is concluded.

In the event of an obvious technical error in a price, status or description, the client is informed without undue delay. A contract is not considered concluded in the case of an obvious error if the order has not been expressly confirmed under the correct terms.

4. Inquiry and conclusion of a contract

Submitting a contact form or message is an inquiry and does not in itself create an obligation to buy or sell.

After the inquiry, the Trader confirms in writing the availability, final price, method and term of payment, courier, delivery price and term, and the particular features of the order.

The contract is considered concluded when the client accepts the terms and receives express confirmation on a durable medium, for example by email. For a personal commission, the personalisation is specified and accepted in writing.

The Trader may refuse performance in the event of depleted availability, impossible personalisation, an obvious error, suspected abuse or another objective reason. Any payment received is refunded without undue delay.

5. Payment

The method, term and any deposit are set out in the individual written offer. The client sees and accepts the final amount and payment terms before being bound.

Production or dispatch begins in accordance with the accepted terms. The Trader issues a sales document in accordance with applicable law.

6. Delivery

The address, delivery availability, carrier, method of receipt, price and term are agreed in writing for the specific order.

Unless otherwise agreed, the goods are delivered without undue delay and no later than 30 days after the contract. A separate term is set for a personal commission.

The risk of accidental loss or damage passes to the consumer upon physical receipt by the consumer or a designated third party other than the carrier, except in the cases provided for by law.

Where packaging is visibly damaged, the client should, where possible, note this with the courier and inform the Trader. Failure to make such a note does not remove the client’s statutory rights.

7. Right of withdrawal

The consumer has the right to withdraw from a distance contract without giving a reason within 14 days of receiving the goods.

Withdrawal is declared unambiguously at sharena.art@gmail.com or to “SHARENIYKI” EOOD, UIC 208518121, 26 Otets Paisiy St., floor 5, apt. 82, Varna, Bulgaria. The goods are returned to the same address within 14 days of notification. Direct return costs are borne by the consumer unless otherwise agreed in writing.

The Trader refunds the amounts received, including standard initial delivery, within 14 days of notification, but may wait until the goods or evidence of dispatch has been received.

The consumer is responsible only for diminished value caused by handling beyond what is necessary to establish the nature and characteristics of the goods.

The right of withdrawal does not apply to goods made to individual requirements — for example a personal inscription, portrait, specific composition or colour scheme. Handmade or unique status alone does not exclude this right.

8. Conformity and claims

The Trader is responsible for the conformity of the goods with the contract. Consumer goods have a two-year statutory guarantee of conformity from delivery.

A claim may be submitted to sharena.art@gmail.com or to the company address, with purchase details, a description of the non-conformity and the preferred statutory remedy.

Where a claim is justified, the consumer is entitled to repair or replacement where possible and, in the cases provided for by law, to a price reduction or termination of the contract.

Care instructions do not restrict statutory rights. Improper use, mechanical damage after delivery and natural wear and tear are not initial non-conformity.

9. Intellectual property

Simona Savova is the author of the paintings and original artworks unless another author is expressly identified. Other content belongs to its respective rights holders or is used with permission.

Purchasing a physical artwork does not transfer copyright. Copying, reproduction, commercial use, the creation of derivative products and the training of AI models without prior written permission are prohibited, except where permitted by law.

10. The Website and external links

The Trader makes reasonable efforts to keep the information accurate and the Website available. Temporary interruptions may occur for maintenance or reasons beyond the Trader’s control.

External links are provided for convenience and lead to services with their own rules. Nothing in these terms limits rights or liability that cannot be limited by law.

11. Personal data and cookies

Personal data is processed in accordance with the Privacy Policy. The technologies used are described in the Cookie Policy.

12. Complaints and disputes

Complaints may first be sent to sharena.art@gmail.com. The consumer may also submit a complaint to the Bulgarian Consumer Protection Commission through kzp.bg and seek the competent conciliation commission.

The European ODR platform has been discontinued and is not referenced. Bulgarian law applies without depriving a consumer habitually resident in another EU country of mandatory protection.

13. Changes

The terms may be updated when the services or the law change. The version accepted when the specific contract was concluded applies to that contract.
